first up is risk assessment: make sure you and the others you’re with will be as safe as possible when recording. if you don’t feel safe recording, watching and being a witness is enough for now!
writing is just as important as filming!!!! any details you can write down, name and contact information of the detainee, where and when the arrest was, how many people were involved, the whole shabang
the agents will most likely try to take your phone or intimidate you into not recording but you absolutely have the right under the first amendment.
“I am exercising my right to document this arrest.” - saying this may not get them off your back but you’re absolutely are allowed to do this. everything on your phone is protected by privacy rights so if they make a grab for your phone (illegal btw) lock it so they can’t get the video. ANOTHER IMPORTANT NOTE things like face ID and finger print unlocking are NOT protected under the 4th amendment so make sure to turn those features off and have a number passcode to unlock your phone!!
ALWAYS RECORD IN LANDSCAPE VIEW!! this gets more background or landmark details that make it easier to note the location of arrest.
if you can DO NOT focus on the detainee and their family or neighbors. I know it seems a little controversial to getting as many details as possible (especially if it’s in a residential area) but having the detainee in the shot makes them, their family and possibly their neighbors more of a target for retaliation. focus as much as possible on the agents/law enforcers, background details, weapons if any, car license plates, etc.
if you feel comfortable pressure them for a warrant and forms of ID. they are required BY LAW to have identification of being law enforcers make sure to get it in video if you are recording. A warrant for arrest must be signed by a judge and will be incredibly detailed. A legit warrant will have the full, legal name and address of the arrestee as well as why they are being arrested and a judge’s signature.
more often ICE agents will get administrative warrants. A VERY VERY IMPORTANT PART OF THIS KIND OF WARRANT IS YOU DO NOT HAVE TO LET THEM IN!!! Administrative warrants do not give the agents/law enforcers the right onto a premises or access to private property unless “invited” in. that is to say, DO NOT OPEN THE DOOR UNLESS THE WARRENT IS A LEGIT JUDICIAL WARRANT!
if you are given orders (ie: step back) record yourself complying (so like point the phone showing you stepping back and complying w the orders). this might seem demeaning but not complying could get you charged with obstruction of arrest :/ (or worse)
speaking of! do not obstruct the arrest, ik I’m repeating myself but doing so opens yourself up to harm and also the potential for arrest or injury (and potentially others if weapons get drawn)
whistles and horn honking have proven to deter unwarranted arrests, HOWEVER if the goal is to observe all the noise makes it hard to hear what is being said.
THIS IS MY OPINION if you are in a group make a scene, safety in numbers logic and chase them away we have seen this working in Minnesota, but if you are by yourself it would be better to take a more passive approach, again in my opinion!!!!!
everything in here is important but if you take one thing away DONT POST THE VIDEOS ON SOCIAL MEDIA LIKE SERIOUSLY
ik it’s SUPER super tempting to post and rage about how unlawful and violent the agents are being and to spread the word but posting them on social media leaves the video open to be edited/tampered with and could discount it as evidence in the future.
if you can, talk to a lawyer and the family members of the arrestee about what to do with the video before posting anywhere. there are also a number of legit organizations that have dedicated spots to turn in videos and written reports for future litigations
if you have the means always make a copy of the video or report and *.✧never stop recording*.✧!!!
especially if you are being pushed around or assaulted that is the most important time to keep the camera rolling!
