The Thanos thought experiment turned into an incredibly lengthy project writing up a new continuity of government plan. I used Claude extensively for drafting, but the ideas were mine (or borrowed from other constitutions). It is, er, extremely long. Currently 32,000 words, including commentary. I could not have drafted all that, obviously, not even close. But Claude turns out to (unsurprisingly) be very good at turning ideas into concrete legal language.

But it’s funny for “huh, what would happen to the US government if the Snap happened” to lead to “and here is a 25,000 word constitutional amendment package that deals with presidential, judicial, and congressional succession for a mass-casualty event, as well as for individual replacement of officers for resignation, death, or impeachment.”

Truly, I think it is is good. I have also not addressed a lot of constitutional policy issues a lot of people get hung up on. Abortion or the second amendment aren’t here, at all, nor is the electoral college (outside of a “this is stupid, we should fix it in another package” note).

Obviously there are a lot of things that could be tinkered around the edges.

The one potentially devastating hurdle is “what to do about SCOTUS”, because there is basically no procedure that allows for a good “continuity of the supreme court” that doesn’t also require term limits. Term limits are good independently, but if you want for the removal of bad SCOTUS judges, or a provision where “we lost 4 judges and suddenly the court cannot function AT ALL”, they are basically mandatory.

Right now, it’s basically fanfic, but I’m going to shop it around (in reduced form) to some policy shops at some point in the near future. But right now, I’m tired…
