i should probably just keep reading drogula’s cato biography but i’m thinking about The Disembowelling and. i am mostly of the opinion that cato killed himself at least in part because he did not want caesar to have the opportunity to gain more extralegal power by pardoning cato via a suspension of ‘normal’ legal process. sure caesar still did this in other cases but cato would be The Big Example

but i wonder if there was also an element of cato avoiding the trap (adjacent to the clodius/cyprus thing) of. the point at which caesar pardons him via above extralegal process is the point at which his power has already extended and it is already too late for cato to argue against it without also arguing against. existing roman law / the mos maiorum etc? which we know from the cyprus incident that he didn’t really do. ig he was avoiding having to acknowledge that caesar’s actions had become synonymous with [what is allowed / legal / you can tell i can’t find the right word here]. avoiding this for himself as much as avoiding the opportunity to let caesar demonstrate this.
the milder course is to be conjectured on the part of caesar. lol
